Home/Glossary/Crime prevention model

A crime prevention model is the set of policies, procedures and controls that a legal entity adopts to prevent, detect and respond to crimes committed in its interest or for its benefit. In Chile, its main framework is Law 20.393 on the criminal liability of legal entities, whose catalogue of offenses was significantly expanded by Law 21.595 on economic crimes. A crime prevention model typically includes a compliance officer, identification of risk activities, protocols and controls, a whistleblowing channel, training, and supervision and update mechanisms. Having a model that is properly implemented and operational can be decisive for the company's position in the event of a potential charge. The Outside General Counsel model makes it possible to keep compliance continuous, and not merely a document on a shelf.
