Four ways of working with us

Not every company needs the same thing. If you have no in-house legal function, we are your legal department. If you already have one, we complement it or add dedicated capacity to it. And if you are not yet operating in Chile, we start by setting you up. In every case the whole firm stands behind the work.

What sets each service apart is not the size of your company or the price, but whether you have an in-house legal function and what kind of need you have. Further down there is a three-question rule that places you in under a minute.

For companies with no in-house legal function

Cubillos Lama operates as your entire legal function, with full coverage, a predictable monthly fee and direct access to partners.

How to tell which one fits

Three questions and it is settled

None of them asks about the size of your team, and that is deliberate. Size determines the profile of the lawyer we assign and the price, not the service that fits you.

    Does your company already operate in Chile?

    If not yet, the starting point is Soft Landing: first the operation is set up and brought into compliance. If you already operate, move on to the second question.

    Do you have an in-house legal function?

    If you do not, the OGC model is the fit. All that remains is choosing between the remote and the on-site delivery, depending on whether the operation already needs someone on the ground. If you do have one, move on to the third.

    Is the need permanent, or does it have a beginning and an end?

    Permanent, whether of capacity or of specialism, means ongoing support services. Limited in time, whether by a project, a spike in workload, an absence or a technical gap, means temporary dedicated services.

What is the difference between the OGC model and ongoing support services?

It depends on whether you have an in-house legal function. Under the OGC model we are your legal department, because you do not have one. With ongoing support services you already have a legal department and we complement it. In the first case we decide and execute; in the second your head of legal decides and we add depth where it is missing.

And between ongoing support and temporary dedicated services?

It comes down to the type of need. Ongoing support is for what you are missing on a stable basis: capacity for the volume, or specialisms your team does not have. Temporary dedicated services cover a need with a beginning and an end —a project, a spike in workload or an absence— with one of our lawyers reserved for you during that period. Ongoing support gives you the breadth of the firm; temporary dedication gives you the availability of one person. The size of your team does not determine which fits: both are available to large and small legal functions alike.

If both the on-site OGC and the temporary dedicated service involve a dedicated lawyer, how do they differ?

In who leads the legal function. In the on-site OGC the lawyer is your legal function, because you have no other, and answers to our technical judgement. In the temporary dedicated service your in-house legal function exists, sets the priorities and leads the matter, and our lawyer adds capacity within that framework. It changes the profile we assign, the scope of the engagement and the price.

Can I have the OGC model and ongoing support services at the same time?

No, and you do not need to. The OGC model already includes everything ongoing support delivers. If you have OGC and a specialist matter comes up, it is covered by your retainer or handled as a specific project, without contracting anything additional.

And ongoing support together with temporary dedicated services?

Yes, and it is the most natural combination. The monthly flow of ongoing support covers your team's day to day, and the temporary dedicated service is switched on when the project, the workload spike or the leave arrives. Both are contracted under the same framework agreement, with separate annexes.

We are a foreign company and do not yet have an entity in Chile. Where do we start?

With Soft Landing, which is the setup service. That is where the structure is defined, the company is incorporated and the operation is brought into compliance. Once the setup is finished you decide whether to continue with the OGC model, and that decision is not a condition for engaging the Soft Landing.
